Question
How will an ADR know if a data holder has received an exemption from the ACCC for one or more of the provisions in the CDR regime?
Answer
Exemptions are published on the CDR Exemptions Register managed by the ACCC. This can be found at:
https://www.accc.gov.au/public-registers/consumer-data-right-exemptions-register#:~:text=The%20ACCC%20may%20exempt%20a,and%20the%20consumer%20data%20rules.
The ability to detect the support for various exemptions is highly dependent on what the exemption is. To date exemptions have mainly been to the implementation of specific aspects of the rules or standards that already have discovery mechanisms such as support for specific account types or the implementation of PAR. These exemptions have often been time limited to limit their overall impact on the CDR ecosystem. Some exemptions have also been granted for discontinued or pilot accounts, which should be relatively easy to identify and differentiate.
