Question
The CDR Rule 9.5(4) states that the copies of records to customers must be provided 'in a form (if any) approved by the Comission for the purpose of this rule'. Has the form been approved? If yes, where is it available? If not when should we expect to have it?
An existing article discusses customer copies of records, but does not clarify the form in which records must be provided.
Answer
The ACCC has not prescribed a form for the purposes of Rule 9.5(3) or (4) and has left the format for making a request and responding to a request open. However, it is expected that the form will be one that can be accessed by the consumer (e.g. if a CDR consumer no longer has access to a consumer dashboard with the relevant CDR participant, they should have some other means of receiving the requested records) and understood by the consumer (e.g. not only in a machine-readable format). We are also open to feedback if participants believe there is a need for the ACCC to consider prescribing forms for the purposes of Rule 9.5. If so, please send feedback to the ACCC's CDR mailbox.
