Question
What associated persons are required to be disclosed for the purposes of the fit and proper person criteria?
Answer
Applicants need to consider and identify which persons within their organisation make decisions that affect the management of CDR data. These persons may include a director or secretary, including directors or secretaries of a subsidiary or holding company, operations managers and any other staff who have influence over the work that is undertaken that can affect or influence the management of CDR data.
When determining who an associated person or entity is within the applicant’s organisation applicants should also refer to the Corporations Act 2001 (Cth) which sets out the definition of associate and associated entity. The definitions include a wide group of individual and corporate persons that are associated with the applicant, including related entities or persons who belong to overseas related entities.
